1. Introduction

Welcome to Arctek. These Terms of Service (“Terms”) govern your access to and use of the website located at www.arctek.co.za (the “Site”) and any purchases you make through it.

By accessing, browsing, registering an account, or placing an Order on the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site.

These Terms are entered into in accordance with the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), the Consumer Protection Act 68 of 2008 (“CPA”), and the Protection of Personal Information Act 4 of 2013 (“POPIA”).

2. Definitions

  • “Customer”, “you”, “your” means any person who accesses the Site or purchases Products from us.
  • “Products” means the digital goods, downloads, licences, or other digital content offered for sale on the Site.
  • “Order” means any offer by you to purchase Products from us.
  • “Business Day” means any day other than a Saturday, Sunday, or official South African public holiday.

3. Eligibility

You may use the Site and place Orders only if you:

  • Are at least 18 years of age, or are an emancipated minor, or have the consent of a parent or legal guardian;
  • Have the legal capacity to enter into binding contracts; and
  • Provide accurate, current, and complete information when registering or ordering.

4. User Accounts

To place an Order, you may be required to register for an account. When you create an account:

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorised access or use of your account.
  • We reserve the right to suspend or terminate accounts that breach these Terms, contain inaccurate information, or are used for fraudulent purposes.

5. Nature of Products — Digital Goods

All Products sold on the Site are digital in nature. This includes, but is not limited to, software, digital downloads, licence keys, digital documents, and online content.

  • Products are typically delivered electronically via the email address you provide at checkout, via an account download link, or by both methods.
  • It is your responsibility to provide a valid and accessible email address and to ensure that emails from Arctek are not blocked or filtered by your mail provider.
  • You are responsible for downloading, saving, and backing up any Products delivered to you. We are not obliged to retain delivered content indefinitely or to re-send it, although we will make reasonable efforts to assist you where possible.
  • Unless expressly stated otherwise, digital Products are sold under a limited, non-exclusive, non-transferable licence for your personal or internal business use. You may not resell, redistribute, sublicense, or publish the Products without our prior written consent.

6. Pricing and Availability

  • All Products, prices, and promotions displayed on the Site are subject to availability and may be changed without notice.
  • Prices are quoted in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) where applicable.
  • We take reasonable care to ensure that Product descriptions, images, and specifications are accurate. However, we do not warrant that such information is free of errors.
  • In the event of an obvious pricing error, we reserve the right to cancel the Order and refund any payment made, in line with section 23 of the CPA.

7. Orders and Acceptance

  • Your submission of an Order constitutes an offer to purchase the Products, subject to these Terms.
  • No Order is binding on us until we confirm acceptance by sending you an order confirmation email.
  • We reserve the right to decline or cancel any Order at our sole discretion, including (but not limited to) cases of suspected fraud, unavailability, or pricing errors.

8. Payment

  • Payment must be made in full at the time of placing the Order, using one of the payment methods offered on the Site.
  • All payments are processed through secure third-party payment gateways. We do not store your full card details on our servers.
  • You warrant that you are authorised to use any payment method you select.

9. Delivery of Digital Products

  • Digital Products are delivered electronically, most commonly by email to the address provided at checkout, and/or via a download link in your account.
  • Delivery is usually immediate or shortly after payment confirmation, but may occasionally be delayed due to payment verification, technical issues, or manual processing.
  • If you do not receive your Product within a reasonable time, please check your spam/junk folder and then contact our support team (see section 17).
  • Risk and ownership in the digital Product pass to you upon delivery, subject to the licence terms in section 5.

10. Refunds and the Consumer Protection Act

Your rights under the CPA and ECTA are not limited by these Terms.

10.1 Arctek 30-day refund policy

In addition to your statutory rights, we offer a 30-day refund policy on digital Products purchased from the Site. If you are not satisfied with your purchase, you may request a refund within 30 days of the delivery date, subject to the following:

  • Refund requests must be submitted via our support channels (see section 17) and include your Order number.
  • For software or licence-based Products, we may deactivate or revoke access to the Product upon issuing a refund. You must stop using the Product and delete any copies in your possession once a refund has been granted.
  • We reserve the right to decline refund requests where there is evidence of abuse of this policy, such as repeated refund requests or indications that the Product has been used beyond reasonable evaluation.

10.2 Statutory rights

  • Cooling-off period (section 44 of ECTA): Where applicable, you may cancel an electronic transaction without reason or penalty within seven (7) Business Days after receiving the Product. Please note that under ECTA, the cooling-off right does not apply to certain digital goods, including (without limitation) goods made to your specifications and audio/video/software recordings where the seal or access has been broken or downloaded. Where these exclusions apply, our voluntary 30-day policy in section 10.1 may still be available to you.
  • Defective goods (section 56 of the CPA): If a digital Product is defective, unsafe, or materially differs from its description, you are entitled to a repair, replacement, or refund within six (6) months of delivery.

10.3 How refunds are processed

Approved refunds are paid back to the original payment method used at checkout. Processing times depend on your bank or payment provider, and typically take between 3 and 14 Business Days after approval.

11. Intellectual Property

All content on the Site and within our digital Products — including text, graphics, logos, images, source code, product descriptions, and software — is owned by or licensed to Arctek and is protected by South African and international intellectual property laws.

Except for the limited licence granted in section 5, you may not copy, reproduce, republish, distribute, decompile, reverse-engineer, or create derivative works from any content or Product without our prior written consent, except as permitted by law.

12. Acceptable Use

You agree not to:

  • Use the Site or any Product for any unlawful purpose or in violation of any applicable law;
  • Attempt to gain unauthorised access to any part of the Site, other users’ accounts, or our systems;
  • Introduce viruses, malware, or other harmful code to the Site;
  • Use automated systems (bots, scrapers, crawlers) to access or collect data from the Site without our written permission;
  • Share, resell, or sublicense any Product or licence key issued to you;
  • Post or transmit any content that is defamatory, infringing, obscene, or otherwise unlawful.

13. Privacy, Analytics and Third-Party Services

Your personal information is processed in accordance with our Privacy Policy and POPIA. By using the Site, you consent to the collection and use of your personal information as described in that Privacy Policy.

13.1 Google Analytics

We use Google Analytics, a web analytics service provided by Google LLC, to understand how visitors use the Site. Google Analytics uses cookies and similar technologies to collect information such as your IP address (which may be anonymised), browser type, device information, referring pages, and pages visited.

This information is used in aggregate to improve the Site and is subject to Google’s privacy policies. You can opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on or by managing cookies through your browser settings.

13.2 Customer support (FreeScout)

We use FreeScout, a self-hosted help-desk platform, to manage customer support communications. When you contact us for support, your email address, message content, and any attachments you send will be stored within our FreeScout instance solely for the purposes of responding to your enquiry, maintaining a support history, and improving our service.

13.3 Email communications

Because most Products and support correspondence are delivered by email, you acknowledge that email is an inherently insecure medium. We take reasonable security precautions but cannot guarantee the confidentiality or delivery of any email communication.

14. Disclaimers and Limitation of Liability

  • The Site and Products are provided “as is” and “as available”, without warranties of any kind other than those implied by law that cannot lawfully be excluded.
  • We do not warrant that the Site or any Product will be uninterrupted, error-free, compatible with all hardware or software, or free of viruses or other harmful components.
  • To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages — including loss of data, profits, or business — arising from your use of the Site or Products.
  • Our total liability to you, arising from or in connection with any Order, is limited to the amount paid by you for the Product giving rise to the claim.
  • Nothing in these Terms excludes or limits liability for death or personal injury caused by our gross negligence, for fraud, or for any liability that cannot be excluded under the CPA or other applicable law.

15. Indemnity

You agree to indemnify and hold Arctek, its directors, employees, and agents harmless from any claim, loss, or expense (including reasonable legal costs) arising out of your breach of these Terms or your misuse of the Site or Products.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a revised “Last updated” date. Your continued use of the Site after changes take effect constitutes your acceptance of the updated Terms.

18. Governing Law and Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
  • Any dispute arising from these Terms will, where possible, first be resolved through good-faith negotiation via our support channels.
  • If a dispute cannot be resolved, it will be referred to the appropriate South African court of competent jurisdiction, or to the National Consumer Commission where appropriate under the CPA.

19. General

  • If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
  • Our failure to enforce any right under these Terms does not constitute a waiver of that right.
  • These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arctek regarding your use of the Site.
